This is an action of contract or tort brought in the Superior Court to recover from the defendant, a corporation engaged in the business of selling invéstment securities, the proceeds, with interest, of a check for $3,120 signed by the plaintiff and collected by the defendant. The case was heard on an agreed statement of facts by a judge, sitting without jury, who found for the plaintiff in •the sum of $3,336.84 and ordered judgment therefor.
