This suit is brought by the trustee in bankruptcy of Phoenix Bond & Mortgage Company, a Massachusetts corporation, to recover funds alleged to have been wrongfully diverted from the treasury of the corporation.
In the fall of 1927, one MacClaskey, who died on December 14, 1930, and one Cashman were substantially equal owners of a Massachusetts corporation known as Hodgdon, Cashman Company, which was doing business as a stockbroker.
