On July 17, 2015, the'court denied the Partial Motion for Summary Judgment filed by defendant Unipres U.S.A., Inc. (“Unipres”) in an Order and accompanying Memorandum, familiarity with which, is assumed. (See Docket Nos. 39, 40.) The court held, inter alia, that plaintiff Fredric Tyler Pelham (“Pelham”) had “met his prima facie burden of establishing that his protected activity bore a causal connection to Unipres’ adverse action.” (Id. at p. 12.)
