Appeal by the defendant, The Atlantic Trust Company, from a-judgment of the Supreme Court in favor of the plaintiff, entered, in the office of the clerk of the county of New York on the 7th day of June, 1898, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 27th day -of June, 1898,. denying the defendant’s motion for a new trial made upon the. minutes.

Rumsey, J.:

On the 1st of July, 1889, the Julien Electric Traction Company issued 102 bonds, in each of which it promised to pay to the Mercantile. Trust Company or the bearer a thousand dollars, with interest at six per cent. To secure the payment of those bonds the corporation gave a mortgage to the Mercantile Trust Company as trustee. On the. 28th of April, 1890, the Union Electric Traction Company made an agreement with the Mercantile Trust Company as trustee, for the-owners and holders of the bonds, by which it guaranteed the payment of the bonds of the Julien Company.
