This was an action on a' promissory note executed and delivered to the plaintiff by the Cushing-Young Shingle Company, defendant. -The complaint after setting out a cause of action in favor of the plaintiff upon the note in suit, further alleges that the plaintiff believes, and therefore alleges, that the defendant as a corporation is wholly insolvent;, that said corporation is unable to pay its maturing obligations in the ordinary course of business, and that it is necessary'for plaintiff’s protection, and for the protection of all creditors…
