Appeal from a judgment of the County Court of Schenectady County (Hoye, J.), rendered May 13, 2002, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the first degree.

In January 2002, defendant pleaded guilty to criminal possession of a controlled substance in the first degree stemming from the seizure in May 2001 of approximately 38 pounds of cocaine in the City of Schenectady, Schenectady County.
