—In an action, inter alia, to recover damages for breach of contract and negligence, the defendant Mountain States Mutual and Casualty Co. appeals from so much of an order of the Supreme Court, Nassau County (Burke, J.), dated November 9, 1995, as denied its motion to dismiss the complaint insofar as asserted *389against it for lack of personal jurisdiction and forum non conveniens. Justice Santucci has been substituted for the late Justice Hart (see, 22 NYCRR 670.1 [c]).
Ordered that the order is affirmed insofar as appealed from, with costs.
