OPINION OF THE COURT
VAN DUSEN, Circuit Judge.
This is an appeal from a judgment in favor of defendants-appellees in a patent infringement action in which plaintiff-appellant’s patent, U.S. Patent No. 3,022,701, was adjudged invalid as being reasonably obvious to one with ordinary skill in the art at the time of invention, within the meaning of 35 U.S.C. § 103. 1 Because the district court found it unnecessary to decide the issue of infringement, the sole issue on appeal is whether the district court erred in holding plaintiff-appellant’s patent invalid on the ground of obviousness. 2 Although…
