These consolidated suits for negligence were tried to a jury. The jury returned a verdict for defendant, upon which verdict judgment was entered. Plaintiffs appeal.

The principal suit is brought by an infant child, through his guardian, for personal injuries sustained when defendant backed his car over the child’s right leg. The other suit, brought by the child’s father, is derivative.

The little boy was 2 years of age at the time. He lived with his grandparents in a summer cottage facing the shore of Saginaw bay, near Caseville. The defendant lived with his family in a nearby cottage, and…
