Parents of a handicapped child seek to enjoin the enforcement of the local school board’s policy that places limitations on tape recordings of parent/teacher conferences. The parents, seeking the unrestricted right to record, contend that their rights under the Individuals with Disabilities Act (“IDEA”) 1 were violated by the policy. The school board moved to dismiss and for summary judgment on the grounds that, because the parents failed to exhaust administrative remedies, the district court did not have jurisdiction and, alternatively, that the school board had…
