GORDON, Vice Chief Justice:

On May 3, 1983 the Court of Appeals affirmed in part and reversed in part the decision of the Superior Court in Gulf Homes, Inc. v. Gonzales, 139 Ariz. 1, 676 P.2d 635 (App.1983). Both parties’ requests for rehearing were denied. We accepted Gonzales and Gastelum’s petition for review solely to determine if the Court of Appeals erred when it denied Southern Arizona Legal Aid, Inc. (“SALA”) attorney’s fees because SALA had not averred that its representation in the underlying lawsuit was proper. We have jurisdiction pursuant to Ariz. Const. art. 6, § 5(3) and…
