Appeal from Shelby District Court.— Hon. O. D. Wheeler Judge. Action to recover damages for false and fraudulent representations made by defendant in inducing plaintiff to become a purchaser of land. Verdict and judgment for plaintiff. Defendant appeals.

The allegations of the petition present several grounds of recovery, but the one ground on which the case was submitted to the jury was, briefly stated: That plaintiff and defendant being residents of the same county in this *652State and mutual acquaintances, and defendant having an arrangement with one Meek, a real estate agent in Missouri, by which defendant was to share in the commissions on sales of Missouri land for which Meek should procure a .purchaser through defendant’s assistance, defendant induced the plaintiff to go with him to Missouri to look at land, and while there introduced…
