ORDER
HARTZ, Circuit Judge
A federal jury convicted Defendant Kenneth Eugene Barrett of three capital offenses arising out of a shootout when law-enforcement officers came to his home to serve arrest and search warrants. We affirmed the convictions and his death' sentence on direct appeal. See United States v. Barrett, 496 F.3d 1079 (10th Cir. 2007) (Barrett I). The district court then denied relief on his motion under 28 U.S.C. § 2255.
