PARKER, Chief Judge.

These are appeals by the United States in two cases relating to damage to real estate, one of which was instituted under the Tucker Act [28 U.S.C.A. § 1346, 2401, 2402] and the other under the Federal Tort Claims Act [28 U.S.C.A. §§ 1346, *4312671 et seq.]. In 1943, the United States leased from Mrs. Kathleen P. Boshamer and others a tract of land, excepting therefrom two tenant houses and an acre of land surrounding each house.
