ARCHER, Chief Justice.

This is a suit brought in the District Court of the 126th Judicial District of Texas by one hundred-odd named firemen and policemen of the City of Austin against the City of Austin, seeking a declaratory judgment “declaring and determining the rights and legal relationships between the Riremen and Policemen and the City of Austin under Articles 1269⅛, Vernon’s Annotated Civil Statutes, and 1583 — 2, Penal Code.”
