This is a proceeding in chancery. The pleadings consist of the bill of complaint, the defendants’ answer and cross-bill and the plaintiff’s replication.

The matter involves the rights of the respective parties in and to a piece of land now abutting, on its westerly side, the present three lane highway between the cities of Montpelier and Barre, known as U. S. Route 302, the southerly boundary of the piece in question being the fine between the city of Montpelier and the town of Berlin.
