The plaintiff is named as beneficiary in a policy of insurance issued by the defendant upon the life of her husband. There was attached to the policy a supplementary contract providing for a payment of an additional $5000 in the event of death by accident. The insured was killed by being run over by a railroad train. The defendant paid the loss due under the principal policy but refused to pay anything under the supplementary contract. The plaintiff brought this action to recover upon this contract and has appealed from the judgment for the defendant.
