The plaintiffs in error were defendants and the defendant in error was plaintiff in the trial court, and they will be referred to here as they appeared there. The plaintiff brought suit against the defendants on a certain promissory note for $1,200, dated January 5, 1921, and due November 1, 1921, bearing 10 per cent, interest from date and providing for attorneys fees in the sum of $10, and 10 per cent, of the principal.
