This suit was brought by Z. T. Price and wife, Amelia Price, against the Nashville, Chattanooga & St. Louis Railway Company and the Pullman Palace Car Company, to recover damages for the expulsion of Mrs. Price from a sleeping car at Tifton, Ga., in September, 1901’.

The suit was brought before a magistrate. There was a judgment there for $500 against the railway company, which was affirmed by the circuit court and by the court of civil appeals. The suit was dismissed in the circuit court as to the Pullman Palace Car Company by consent of counsel for the plaintiffs below. A writ of certiorari…
