—In a proceeding pursuant to CPLR article 78, inter alia, to compel *639the Town of Brookhaven to restore and reinstate the petitioner to his position of Chief Lifeguard with back pay and benefits from the date of termination, the appeal is from an order and judgment (one paper) of the Supreme Court, Suffolk County (Doyle, J.), dated October 16, 1995, which, inter alia, granted the petition, and dismissed the affirmative defenses to the petition.

Ordered that the order and judgment is modified by (1) deleting the first, third, fourth, fifth, sixth, seventh, and eighth decretal paragraphs thereof…
