Defendant and appellant was charged with violating section 217 of the Penal Code (assault with intent to commit murder) upon the person of Jewell Forney. It was also charged in the information that he had been twice previously convicted of a felony (forgery and assault with a deadly weapon—three counts) and served terms of imprisonment therefor. Defendant admitted the prior convictions. A jury found him guilty of the offense charged. Defendant and Jewell Forney began living together in December, 1954.
