The Chief Judge of the Boston Housing Court has reported the issue of the propriety of a preliminary injunction he entered pursuant to G. L. c. 186, § 14, and G. L. c. 111, § 127H, granting certain relief to a tenant at suffer ance. Mass. R. Civ. P. 64, 365 Mass. 831 (1974). The judge’s basic concern was whether he was correct in granting relief under these statutes to a tenant at sufferance.

The plaintiff, a tenant at sufferance in an apartment owned by the defendant, filed a complaint in the Boston Housing Court, seeking, among other relief, an order that the defendant make certain repairs…
