Appeal from a judgment of the Supreme Court (Teresi, J.), rendered September 2, 2003 in Albany County, upon a verdict convicting defendant of the crime of assault in the second degree.

Defendant stands convicted of assault in the second degree stemming from an early morning altercation in a bar on April 15, 2002, during his final year at the State University of New York at Albany. Specifically, defendant struck another patron (hereinafter the victim) in the face with a glass causing serious injuries. He was sentenced to 21k years in prison and now appeals.
