KANNE, Circuit Judge.

After being convicted of mail fraud and conversion, Nancy Melody and her husband Thomas were each sentenced to four-years imprisonment. As a result of her comments at sentencing, the district court stayed the execution of Nancy Melody’s sentence until her husband’s release so that their children would have one parent at home. The untimely death of Thomas intervened before his four-year sentence had been completed. After her husband died and prior to her incarceration, Nancy Melody filed a “motion for relief from sentence” pursuant to 18 U.S.C. § 3651 and Rule 35(a). She…
