The defendant, George J. Gallagher, was Fire Marshal of the City of Philadelphia, that office having been created by the Act of 1911, P. L. 705, 53 PS §3591 et seq. Under the Act of 1901, P. L. 361, 53 PS §3542, and various ordinances of the City óf Philadelphia, 1 permits for the installation of high explosive (here, fuel oil) equip-, ment are granted by the Mayor upon applications which must first be approved by the Fire Marshal’s office.
