KAUGER, Justice.

The questions presented are whether the trial court abused its discretion when, in a partition action, it granted attorney fees figured on a percentage of the sale price of the land instead of computing the fees based on an hourly rate; and whether the failure to stay or supersede the judgment waived the appellants’ right to appeal after their lawyer cashed the voucher issued by the county clerk to satisfy court-awarded attorney fees.
