Plaintiff Agence France Presse (“AFP”) seeks a declaratory judgment that AFP did not infringe Defendant Daniel Morel’s (“Morel”) copyrights in certain photographs. Morel counterclaims against AFP alleging violations of the Copyright Act of 1976, 17 U.S.C. § 101 et seq., the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 1202, and the Lanham Act, 15 U.S.C. § 1125.
