MEMORANDUM AND ORDER

MORAN, District Judge.

Plaintiffs originally brought this action pursuant to 42 U.S.C. § 405(g) seeking review of the decision of the Secretary of Health and Human Services (Secretary) denying plaintiffs’ request that the Secretary waive recovery of overpayments of social security benefits under 42 U.S.C. § 404(b). The cause was referred to Magistrate James T. Balog, who found that there was not substantial evidence to support the Secretary’s refusal to waive recovery. This court accepted Magistrate Balog’s report and recommendation and granted plaintiffs summary judgment.…
