LOZANO, District Judge.

The plaintiff, Retter Teamer (“Teamer”), brings this action pursuant to § 205(g) of the Social Security Act (“Act”), 42 U.S.C. § 405(g). Teamer seeks judicial review of the Secretary of Health and Human Services’ (“Secretary”) final decision denying Teamer a waiver of repayment of an overpayment of Social Security benefits. This matter is before the court on Teamer’s Motion for Summary Judgment filed on December 3, 1986, and the Secretary’s Motion for Summary Affirmance filed on January 30, 1987.
