Knutson, Justice.

This is an appeal from an order denying defendant’s motion for judgment notwithstanding the verdict or for a new trial.

The facts essential to a determination of the issues presented here may be briefly stated. On the early morning of March 29,1958, Irvin O. Evenson and Halvor George Lynghaug were found seated in an automobile parked near the curb on Marshall Avenue in St. Paul. The motor of the automobile was running at the time it was seen by St. Paul police officers. When the car doors were opened there was a strong odor of gas.
