In the above styled law action the plaintiff seeks to recover judgment against either or both defendants based upon a $15,000.00 promissory note which purports to have been executed on behalf of both corporations by Tomie F. Osborne, Secretary/Treasurer of both Condor Coal, Inc., and Big Valley Mining, Inc. A third party motion for judgment was filed by both Condor Coal and Big Valley Mining against Tomie F. Osborne seeking to recover for any judgment which the plaintiff, Jack A. Helms, might be awarded. By agreement the parties submitted all issues of fact and law…
