Appeal from superior court of Grand Rapids; Dun-ham (Major L.), J. Bill by J. Boyd Pantlind and others against the city of Grand Rapids to enjoin the enforcement of a garbage ordinance. From a decree for plaintiffs, defendant appeals.

We quote from an ordinance of the defendant city:

*19“An ordinance providing for the regulation, collection, ' removal and cremation of garbage, offal, dead animals and other refuse matter, and for the regulation of the crematory in the city of Grand Rapids.”
“Sec. 2. It shall be unlawful for any person residing within the limits of the city of Grand Rapids or elsewhere to deposit, throw or place any garbage, offal or dead animals in any lane, alley, street or other public place within the city of Grand Rapids; nor shall any person place any garbage, offal, dead animals or other refuse • matter…
