The petitioner is a scavenger in the city of Oakland, and was convicted of gathering and removing garbage in violation of an ordinance of that city, and his conviction in the police, court of the city of Oakland was affirmed in the superior court of Alameda County. The petitioner claims that the ordinance under which he was arrested and convicted is void and unconstitutional.
