MEMORANDUM OPINION AND ORDER

BABCOCK, District Judge.

Defendants Rockwell International Corporation (Rockwell) and Dow Chemical Company (Dow) are past operators of the Rocky Flats Nuclear Weapons Plant (Rocky Flats) in Colorado. Plaintiffs are former employees of Dow or Rockwell and labor unions whose members work at Rocky Flats. Before me are defendants’ motions to dismiss. Defendants contend that plaintiffs’ claims are subject to the exclusivity provisions of Colorado’s Workmen’s Compensation Act.
