Pending before the court is Defendants The Kroger Co. (“Kroger”) and Charles Hembree’s (“Hembree”) Motion for Summary Judgment (# 18). Kroger and Hem-bree seek summary judgment on Plaintiff Elaine Martin’s (“Martin”) claims of racial and sexual discrimination and retaliation under the Texas Commission on Human Rights Act (“TCHRA”) as well as tortious interference with existing and prospective business relations.
