This action was brought by Ulysses Houston, administrator of the estate of William Houston, deceased, to recover damages from L. B. Strickland and the Tri-State Coach Corporation for negligently causing, as alleged in the notice of motion, the death of plaintiff’s intestate.

There was a trial by a jury which resulted in a verdict for the plaintiff. At the conclusion of plaintiff’s evidence, counsel for defendants moved the court to strike the evidence, on the ground that it was insufficient to sustain a verdict for the plaintiff if the jury should so decide.
