CUMMINGS, Chief Judge.
Plaintiff Franklin Brown appeals from the district court’s grant of defendant’s motion to dismiss for failure to state a claim upon which relief can be granted. Fed.R.Civ.P. 12(b)(6). The court ruled that plaintiff’s complaint charging a violation of Title VII was time-barred because it was not filed within ninety days of receiving a Notice of Right-to-Sue from the Equal Employment Opportunity Commission (EEOC) as is required by Section 706(f)(1) of Title VII, 42 U.S.C. § 2000e-5(f)(l).
