Defendant-appellant Kraft, Inc., appeals from the decision of the district court denying its motion for judgment on the pleadings. We affirm.

On March 3, 1983, plaintiff-appellee Daryl Valenzuela filed a complaint in California state court alleging sex discrimination by Kraft in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2. The state court action was filed within 90 days from Valenzuela’s receipt of a right to sue letter from the Equal Employment Opportunity Commission (EEOC).
