In this case, plaintiffs, owners of neighborhood convenience stores (“owners”), and an association to which they belong, the Midwest Retailers Association (MRA), challenge a municipal licensing scheme that aims to regulate their businesses. Defendant City of Toledo (“City”) has distributed license applications to the plaintiffs under newly-enacted Toledo Municipal Ordinance 797-07 (“T.M.0.797-07”).
