LUCAS, District Judge.

Plaintiff filed a complaint under 15 U.S.C. § 1071(b) for restoration of a trademark filed with the United States Patent Office. The trademark, “CURL & CONDITION,” refers to a permanent wave lotion for which the Patent Office issued Registration No. 858,448 on October 8, 1968. On October 29, 1970, the Trademark Trial and Appeal Board of the Patent Office granted defendant’s petition for cancellation of the trademark. 168 U.S.P.Q. 187.
