This matter is before the court on a motion to dismiss submitted by defendant, United States of America (“government”). See Docket No. 9. This action for monetary damages was originally commenced, and later amended, by plaintiffs Nelson Cortes Castillo (“Cortes”), his wife Francisca Roman-Cancel (“Roman”) and the conjugal partnership existing between the two, pursuant to the Federal Torts Claims Act (“FTCA”), 28 U.S.C., § 2671 et. seq., and supplemental state jurisdiction.
