Plaintiffs Nelson Cortes Castillo (“Cortes”) and Francisca Roman Cancel (“Roman”) (collectively “plaintiffs”) filed suit against the United States of America (“defendant”) under the Federal Torts Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b), 2671-2680. Plaintiffs’ complaint alleges that the Department of Veteran Administration’s (“VA”) negligent reduction of Cortes’s disability benefits caused them mental suffering and property loss.
