Dawson, J.:

This was an action to enforce a claim for compensation for alleged injuries sustained by plaintiff through exposure while working in and out of defendant’s meat-cooling plant. The alleged exposure occurred on September 26, 1917. The action was originally begun on September 24, 1920. It was removed to the federal court and there dismissed without prejudice on April 12,1921, *432and this action was begun July 5, 1921. In the petition filed by plaintiff on July 5, 1921, he attempted to state a cause of action as follows:
