The grand jury returned indictments against the *487defendant, Perdite Scott, in connection with separate incidents involving two different victims. The first incident took place on the evening of June 2, 1998; the defendant was charged with assault with intent to rape, rape, assault and battery, and indecent assault and battery, all upon Lucy Smith,2 a woman over the ' age of fourteen.3 The second incident occurred on the evening of July 21, 1998, and the defendant was charged with assault and battery, and assault with the intent to rape Jane Doe.
