A Superior Court jury found the defendant guilty of murder in the first degree by reason of extreme atrocity or cruelty. On appeal, the defendant contends that the motion judge improperly denied his motion to suppress evidence, and that the trial judge committed reversible error by improperly instructing the jury on the third prong of malice aforethought and omitting instructions on involuntary manslaughter and criminal responsibility.
