— If the insufficiency of the report of the viewers be overlooked, and we take the case, not merely as it appears of record, but as the appellant alleges it to be, it is evi*343dent that what is complained of is the occupancy of a public street by the railroad company, and not the taking of any of the appellant’s land within the meaning of the constitutional provision or of the Acts of Assembly incorporating the company.
