The appellant, the Virginian Railway Company, was the defendant in all three eases herein, and the appellees were the plaintiffs, and will hereinafter be referred to as the defendant and the plaintiffs, respectively.
The cases of Fitzgerald and Hylton, Nos. 3015 and 3016, were tried together in the District Court by agreement of the parties. The District Court directed a verdict for the plaintiff in all three cases. All the appeals present the same questions of law, with little variation in the facts, and by agreement of all parties the appeals were heard…
