LUJAN, Chief Justice.
During the month of March, 1932, the plaintiff, by verbal agreement, leased to the defendant certain agricultural lands situated in Rio Arriba County, upon the terms and conditions that the defendant should pay unto the plaintiff as rental therefor one-half of the hay crops and one-fourth of the row crops produced 'thereon, payable ánnually at harvest time. It was also agreed that the defendant should farm, plant and harvest said crops in a good and husbandlike manner and that he would perform such ditch work as was necessary to perfect plaintiff’s water rights.
