On the 9th of May, in the year 1839, James S. Prather, of the city of Louisville, by an assignment and ^conveyance of record, vested in William Prather, Charles Way, and John Joyes the title to certain real estate and choses in action therein described, to be held by them in trust for the payment of his debts, and then held in like manner for the use and benefit (after his death) of his widow, should she survive him, and his children, and upon the death of both the grantor and his wife to be equally divided between the children.
