This diversity action arises out of two incidents in which customers at Subway Restaurants in New York and North Carolina discovered seven-inch serrated knives baked into the bread of their sandwiches. Plaintiffs John Agnesini (“Agnesini”) and Terrie Moody (“Moody”) (together, the “Plaintiffs”) bring claims for negligence, strict products liability, breach of implied and express warranties, and negligent supervision and training against defendant Doctor’s Associates, Inc.
